PLEASE I NEED ADVICE ON MOVING OUT OF STATE WITH MY SON! kelley1: I HAVE SOLE CUSTODY OF MY 8 YR OLD SON SINCE BIRTH AND I WANT TO MOVE OUT OF STATE ,I'M IN KISSIMMEE ,FLORIDA..I WANT TO GO BACK TO OHIO A SMALL TOWN THAT IS VERY PEACEFUL NO VIOLENCE,AND A BETTER ENVIROMENT TO RAISE MY SON..A YR AGO WE WERE AT A GAS STATION AND MY 8 YR OLD WITTNESSED A GUY GET STABBED AND WALKING W/BLOOD DRIPPING EVERYWHERE,HE STILL REMEBERS THIS ..NOT FAR FROM MY HOUSE (LESS THAN AS MILE) A GUY WAS RUNNING CARRYING A STERIO ,I HATE THIS PLACE AND I FEEL LIKE MY OLD HOMETOWN WOULD BE BEST FOR MY SON TO GROW UP IN..... ???,HIS FATHER SAYS NO AND WON'T AGREE TO IT ,HE IS NOT ON THE BIRTH CERTIFICATE AND MY SON DOESNT HAVE HIS LAST NAME AND WE WERE NEVER MARRIED NOTHING HAS BEEN DONE IN COURT...CAN I GET IN TROUBLE IF I GO AHEAD AND MOVE??????? I AM GOING TO SEND MY SON SUMMERS,HOILIDAYS ECT..DO I NEED PERMISSION TO LEAVE CONSIDERING EVERYTHING I JUS STATED???ALSO HIS FATHER HAS HAD DUI'S AND LICENSE REVOKED FOR 5 YRS BUT IS NOW ABOUT TO GET PERMIT.

HOWEVER -

if you have no custody agreement in place, and you send junior to dad on vacation, he may NOT be legally obliged to send him BACK to you.

it will be money well spent to viist your friendly neighbourhood attorney.

this is not an area where you want to be surprised later.

I lived in Florida. My stbx and I decided to get a divorce. Our lease was up and my lawyer gave me options but she advised me not to leave my son because it would be difficult getting him back. "Abandonment issues". So I did. My son's father was upset of course threatening that I was kidnapping my son.etc. My lawyer responded to his lawyer saying that I had no other place to go so I went home where my family is. We had an emergency hearing and because its crowded at my moms house and my son's father recently moved into a 3 bedroom and offered for us to stay there until I find something. The judge didn't see a problem with it. Now mind you he cheated on me and I don't think its such a good idea to do that but now if I don't it would make me look bad.
