Filing for Uncontested Divorce, doing it myself LettinGo: I know the legal board is usually slow, but I have no where else to ask, so I figured I'd give it a shot.

Although STBX "said" he would gladly sign the divorce papers (uncontested) if I filed them, I had my doubts, but so far he did sign the Affidavit of Defendent.  Now I am getting together the other million papers so I can have it placed on the court calendar.

My question is this:

We already have Child Support and Custody/Visitation court orders in place through the family court.  Do I still have to fill out the three separate packages regarding Child Support (worksheet, collection, etc.).  I called the county clerk, and spoke to the woman who supposedly processes all this, and she told me "I don't think so".  Gee, was kind of hoping for a more solid answer.  I don't want to take the day off, take all my papers up there and find out I am missing something.

Next question ... my STBX signed a Quit Claim over a year ago and the house is only in my name.  Do I still have to fill out the section so that I can receive exclusive use of the marital home??  I was hoping to not bring that up again.

I am in NY, btw.  I hope someone out there has done this and has some advice. THANK YOU!

Re: Filing for Uncontested Divorce, doing it myself LettinGo: Well, a lot of people read but no advice which is Okay because I know that these are tough questions.  8)  I just wanted to update everyone and say that today I filed my final batch of papers, and they should be signed within 1 - 2 months (the longest).  Hurray!  So, I did it myself, and it CAN be done!

And then, all that's left to do is change my last name.
