He didnt file????? Angel: My lawyer called me and said that he didnt file he wants to go with an agreement???? ??? i dunno what this means? anyhow 4 weeks ago he said he was going to file and that the sherrif will be serving me with papers and all.Can anyone explain this? and dosent someone need to file??? does anyone know why this happens?????

I do know however that it is better to be the filer of the divorce as opposed to the person filed upon...
Sheriffs do sometimes bring the paperwork but mine came as certified mail which I had to sign...

Re: He didnt file????? turning leaf: What kind of agreement? If you're married and you want to end the marriage, you file for divorce or annulment. If the agreement is a Marital Settlement Agreement, it is a form that is attached to a Dissolution of Marriage petition. You both sign that MSA.

but the question is dont you have to file if you want a divorce???
