Filed my complaint/Adultery Question NJdad: It can be quite overwhelming when you see all of the stuff talked about actually written down! My lawyer put together quite a complaint. Some of the highlights:
Filed on grounds of adultery, willful desertion, and extreme cruelty
awarding of joint legal custody for our child
Designating ME as the "parent of primary residence" and the stbx as "parent of alternate residence"
Defendant to contribute support to me and child
equally distribute property
restraining her from using my last name
and some other stuff as well. I realize that I may not get everything in there, but I think this is part of the "shoot for the moon" theory.
I was also told that the "other man" in this equation is going to be served as well. Does anyone know how that works? What does he actually get served with? I am guessing that it it is just some sort of paper that declares he is part of this complaint.
Re: Filed my complaint/Adultery Question crissy: hi. just wondering what type of proof you have to proove your case? i have my h and his ow cheating on videotape. my attorney told me that it is useless because it was after my h already moved out!
i don't know how the law can say that even though you are legally still married that it is ok to cheat!
i hope you get everything! i would think since you filed on the grounds of adultery that you will be entitled to more.
my attorney is going to bring up the adultery during the proceedings but i am not sure how much it will help me considering my hard evidence is after he moved out.
i think it's great that the om is being bought into this. they will have plenty to talk about for several months at dinner!!! it will be soo stressful for him to be involved in this!

Re: Filed my complaint/Adultery Question mixed-up: Unfortunately for me; in the state I live in you are not entitled to more because your spouse cheated.
You will have to research the laws in your state to know whether cheating "proof" will help your case.

Re: Filed my complaint/Adultery Question galil: Most states are no fault states anymore. meaning they dont care who is doing who and when. You need to see if your state is a no fault state, if it is then even if you have the pope testify it will be mood at best.
