Parental Rights (Children) CaptainBligh: I am not married officially but as for common law I am. She threatens to leave me to another state with my son. Can she leave to another state? What can I do to keep her local so I can be with my son? She is a good mother so custody will be almost impossible. What rights do I have as far as visitation goes? :'(
Re:Parental Rights (Children) cezrskids: NEVER say, you will never because she's a good mother. Are you a bad father to him? Don't discredit yourself becaused your discouraged. Go to a local library and research what you can do. Since he is not your biological son you have rights, through common law, look them up and see what rights you have. ;)

Re:Parental Rights (Children) in_search_of: The question is not if you have rights as a parent because of the marriage common law or not, you still have rights as a parent whether you were married or not!
And as far as the common law marriage goes there are only about 5 states that still recognize common law as a true marriage, so that may or may not even be an issue.

I know in Ohio common law doesn't exist anymore, don't know about your state. However, you have to exercise your right as a parent. Married or not, you have rights as a parent.

Re:Parental Rights (Children) outpost: I know one way to keep her from leaving. You go file for visitation rights. You will probably have to take a perturenty test since you are not married. If you get visitation rights through the courts, she will hve to ask a judge if she can leave the state.
