Will I lose the house too?! claire: I've got a legal question for anyone who might be able to help - even a website reference would be appreciated. Shortly after my estranged husband and I got engaged, we decided to buy a house. Because I had the larger salary and I was a first-time home buyer, he suggested that I do the pre-qualification and execute the mortgage documents. I did that, we both went to the closing, he gave me half of all financial requirements, but the mortgage and all other legal documents were executed by ME. He paid half the mortgage every month until he moved out a few months ago. My question - can he argue that he should be entitled to our house - 50/50 like marital property because we had an understanding that the house would be our marital home? I'm sure he wants the house, but I want it too - without a court fight. Any advice would be much appreciated.
