Income taxes jskz: Can anyone give me info on filing my taxes this year? I live in Michigan. My divorce will be final in 4 days. I can't really find any info on this. I don't know how to file and who gets what for deductions. we have no children. Does Turbo Tax ask and then calculate for divorce? Or should i have an accountant do my taxes this year.
Re:Income taxes jason_stl: Don't quote me on this, but it is just like paying property tax. If you are married on 12/31/2004 then you will have to file married-joint or married-separate.


Re:Income taxes ChristyM: I lived in Indiana and was still legally married as of 12/31/03 so we had to file jointly. We simply agreed to split the refund as we had comparable incomes.

However, you are not going to still be married so you have to file separately. Didn't your attorneys address this issue in your separation agreement and subsequent final divorce decree? If not, you will want to get it handled now so as to not have to haggle over who pays what and who gets what benefit in the weeks and months to come.

If your divorce is final in 2004 and you had assets/real estate, your separation agreement was supposed to have all that addressed. In both cases you'd file as single, however your agreement is supposed to address any property/deductions. In this case, you need to discuss this with the attorney and get it in the agreement.

When your divorce is final, there should be no questions as to who gets what and claims what. Everything should be in the agreement.

my divorce will be final in 2005, and my attorney asked if I wanted to file jointly or single...and said if the return was less than $500, may not be worth it to haggle and keep in contact with stbx, and that i should check out, and do a mock standard deduction...
anyone have a simular situation? and what did you do?
I'm in California.
