Car loan in her name

Car loan in her name Brian75034: We are divideing up the assests and I agreed upon to take the car that still has a note on it.  Problem is, the note/lien is in HER name/ her maiden name.  

Can the court order the bank to change the note in MY name?  I know banks just cant change the loan to someone else.  Would they have to do a credit check on me?  Would it essentially be to "Refinance" the note?  Which I really really dont want them doing.  I plan on selling it right away anyways.

In my case, I signed it over to my ex-wife. The bank actually will take your name off the loan if you both a gree and sign some papers. We did this before we went to court. Also, if the note and the title say Mr. or Mrs. Smith.. then in my case, my ex wife didn't need my permission to do anything. She could change what ever she wanted when enver she wanted. I was a stickler though, I wanted my name off everything Asap

Did you have to show the bank proof of getting a divorce or something?  I cant see how a bank would just say "ok, we will change the name on the loan".  Maybe being legally married, though, its actually easier than im thinking it is.

I guess they don't care who's name is on the loan as long as they get paid. The title to the car can get tricky.. that's what show's ownership. as in my last post check to see if it says...for example..  Mr. AND Mrs. Smith or Mr. OR Mrs. Smith..

it makes a difference. It it's AND both will need to sign some papers. If it's OR, either one of you can do what you want with it..

How is this one for your........My husband has the Yukon "family car" in my name, through my credit union and my daughter and I are squeezed into a tiny compact car.  Car seat does not fit well in bucket seats.  Husband pays 700.00 for that stupid tank and  refuses to give it up, so I have to "help him" transfer the title over.  Selfishness, selfishness.
